Selling a home in a 55+ community in the Toms River, NJ area differs from a typical sale in three ways: the community's age rules shape who can live in the home, the homeowners association has its own transfer paperwork and approvals, and your marketing needs to reach buyers who qualify. The price still comes from recent comparable sales, ideally within the same community and section. Start by pulling your association's governing documents, because they set most of the rules that apply to your sale.

Which 55+ communities count as "Toms River"?

Many sellers say "Toms River" for communities that carry a Toms River mailing address but sit in a neighboring township. Holiday City, off Route 37 near Garden State Parkway Exit 82A, is a good example: it is in Berkeley Township and uses a Toms River post office and ZIP code. It is made up of separately run associations, each with its own clubhouse, pool, rules, and fees. That matters, because your section's rules, not the whole development's, govern your sale. Taxes and municipal requirements follow the township the home is actually in, so verify with that township's offices.

Who can buy my 55+ home?

Anyone can buy, but occupancy follows the community's age rules. Communities typically require at least one resident to be 55 or older, and many limit how long younger guests can stay. For example, the Holiday Heights handbook requires at least one occupant to be 55+ and limits stays by anyone under 18 to 90 days a year. Rules differ by association, so we confirm yours before listing and describe them accurately and neutrally in the marketing.

What HOA paperwork do I need to sell?

Expect the association to require notice of the sale and its own transfer documents. Ask your association office early for:

  • The current Declaration, Bylaws, and Rules and Regulations
  • Its sale or transfer notification process and any buyer approval or interview steps
  • Any resale or transfer fees, and who pays them under your documents
  • Recent budget and any planned assessments

Hand these to your attorney and to buyers early so nothing stalls the closing.

How do I price a home in a 55+ community?

Use recent sales in your own community, and your own section if possible, of the same model. Updates such as kitchens, baths, HVAC, and roof age carry real weight, because many buyers want move-in ready. When I price a 55+ home, I compare it with model-for-model sales before I look at anything outside the gates. My Toms River community guide and the seller overview explain the wider market, and the listing marketing plan shows how we reach qualified buyers.

Is this different if I'm selling a parent's 55+ home?

Often, yes. If an owner has passed away, the estate's executor usually signs, and heirs under the age limit may own but not live in the home under many associations' rules. Talk with an estate attorney first, then with me about timing.
